@ Qwiader

This is called "Li3aan"-"اللعان".
And it's very unrecommended in Islam, because swearing in God(الحلف بالله) is a dangerous sin if the testifier was lying.

And also, there's another case, when the man and woman who committed adultery felt remorse for their crime and decided to get married lawfully before they get caught. And in this case, the punishment will no longer be applied on them.

I asked my religion teacher about this a long time ago when I was still a school kid(In Saudi Arabia, where we used to take 5 Islamic materials, including the Qur'an lesson).

Salam..
I liked the article and it was an interesting and knowledgeable read.

I agree with the writer's analysis (which makes sense) and would wonder, why would someone feel ok towards committing adultery or consider it as freedome?

The observer: Islam is aware about the chaos that may be generated by committing adultery esp when it comes to whose child is this and being unsure about fathers and children. It is not easy at all. While, there is a punishment for sexual practices other than intercourse which is called (Ta'zeer) which gives the islamic ruler the right to decide a punishment for both sinners and the punishment may not be as strict as the penalty of those who committed adultery

There is a case where you don't need 4 witnesses. Instead, the person in question (in this case the husband or wife) would testify 4 times that he has witnessed adultery and a 5th time that may the curse of god be upon himself if he was a liar
And would prevent the accused from getting the punishment to testify 4 times that he is a liar. And a fifth one that the wrath of god may be upon her if he said the truth.

-No punishment/death involved!
For reference check Souret "El Nour", Ayat: 6 through 9

The Observer
After reading more on this topic I found that Islam would consider applying adultery when it's in public (note the four witnesses) and when one of the two want purify.

Which doesn't seems to be harsh at least to me.

Bilal
You welcome.

N Non
I don't have much information about Misyar and Muta'a, I'm sorry.

Many scholars make it easy to have sex legally through "zawaj misyar" and "zawaj muta'a". Common sense would call these forms of marriage adultery, although common sense is not to be involked in such discussions.

I personally believe that this is harsh and glad that they don't apply it here in Jordan.

What is the definition of sex in Islam? Is it just intercourse?

I mean what if a man and woman had oral sex? Is their a rule for punishing such act? or is it left to be paid in after life?
